NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Karen Yanelli, LLC, doing business as Karen Yanelli Physical Therapy, is required by law to maintain the privacy and security of your protected health information, provide you with this notice of our legal duties and privacy practices, follow the notice currently in effect, and notify you following a breach of unsecured protected health information.
How we may use and disclose your information
We may use or disclose protected health information for treatment, payment, and health care operations; to communicate with other professionals involved in your care; to obtain payment and administer billing; to operate, improve, and manage the practice; when required by law; for public-health and safety activities; to address workers’ compensation matters; to respond to lawful requests in judicial, administrative, or law-enforcement proceedings; and for other purposes permitted or required by HIPAA. We will not use or disclose your information for purposes not described in this notice unless you authorize us in writing. You may revoke an authorization in writing, except to the extent we have already acted on it. To the extent we maintain substance use disorder patient records subject to 42 CFR Part 2, we will not use or disclose those records in civil, criminal, administrative, or legislative proceedings against you without your written consent or a qualifying court order and subpoena, as applicable.
Your rights
You may request an electronic or paper copy of your health record; request correction of information you believe is incorrect or incomplete; request confidential communications in a specific way or at a specific location; ask us to limit certain uses or disclosures, although we are not always required to agree; request a list of certain disclosures made during the prior six years; receive a paper copy of this notice; and choose someone to act on your behalf when legally authorized.
If you pay for a service in full out of pocket, you may ask us not to disclose information about that service to your health plan for payment or health care operations, and we will honor the request unless the law requires disclosure.
Our responsibilities
We will use or disclose only the minimum information reasonably necessary when the minimum-necessary rule applies. We will not sell your protected health information or use it for marketing without written authorization when authorization is required. We will accommodate reasonable requests for confidential communication and respond to requests concerning your HIPAA rights as required by law.
Complaints and questions
You may contact the practice with questions or complaints. We will not retaliate against you for filing a complaint. You may also file a complaint with the U.S. Department of Health and Human Services, Office for Civil Rights, at hhs.gov/ocr/privacy/hipaa/complaints.
